DECISION AND ENTRY SUSTAINING DEFENDANT'S SECOND
EMERGENCY MOTION FOR REVISED SCHEDULE ALLOWING IT TO FIND
AND PREPARE A NEW CASE-SPECIFIC EXPERT IN ONCOLOGY (DOC.
#83); NEW TRIAL DATE AND OTHER DATES SET
Pursuant to the reasoning set forth in the memorandum accompanying the Defendant's Second Emergency Motion for a revised schedule allowing it to find and prepare a new case-specific expert in oncology (Doc. #83), as well as pursuant to the record made in a series of telephone conferences between Court and counsel, the Defendant's Motion is sustained.
Trial upon the merits of the captioned cause, heretofore set for July, 2014, is hereby ordered reset to 9:00 a.m. on Monday, February 9, 2015. The final pretrial conference, to be held by conference call telephone communication, will be held at 5:00 p.m. on Tuesday, January 27, 2015. A jointly prepared pretrial order must be filed not later than the close of business on Tuesday, January 20, 2015. All trial exhibits must be exchanged, by and between the parties, not later than the close of business on Friday, January 23, 2015. All trial related motions, such as motions in limine, etc., are to be filed not later than the close of business on Tuesday, January 13, 2015. All potentially case dispositive motions, such as motions for summary judgment, etc., must be filed not later than the close of business on December 2, 2014. All discovery must be completed by the close of business on November 3, 2014. Defendant is to retain a new expert witness and have the expert's opinion in written form presented to the Plaintiff no later than October 1, 2014.
