ORDER MODIFYING CASE SCHEDULE

JAMES WARE, District Judge

This Court, having considered Plaintiffs' Miscellaneous Administrative Request to Modify Case Schedule, Defendant's Opposition to Plaintiffs' Miscellaneous Administrative Request to Modify Case Schedule, and Defendant's Miscellaneous Administrative Request for a Case Management Conference Regarding Motions for Summary Judgment of Invalidity of U.S. Patents Nos. 6,238,415, 5,895,385, and 6,010,498, hereby sets the following deadlines:

• Reply expert reports shall be due on or before October 25, 2004;

• Cordis' Motion for Summary Judgment of Invalidity shall be due on or before November 1, 2004;

• Plaintiffs' Opposition to Cordis' Motion for Summary Judgment of Invalidity shall be due on or before November 22, 2004;

• The close of all fact and expert discovery shall be on December 10, 2004;

• Cordis' Reply to Plaintiffs' Opposition to Cordis' Motion for Summary Judgment of Invalidity shall be due on or before December 13, 2004;

• The hearing date on Cordis' Motion for Summary Judgment of Invalidity shall be on January 24, 2005;

• The final deadline for any and all hearings on dispositive motions shall also be January 24, 2005; and

• The preliminary pre-trial conference setting shall be on February 28, 2005.

Additionally, the parties shall meet and confer in good faith to develop a joint statement that lists, in their view, any unresolved motions pending before this Court, if any, and projects, to the greatest extent possible, any forthcoming motions. This joint statement shall be filed on or before Friday, October 29, 2004.
