ORDER ADOPTING REPORT AND

RECOMMENDATION AND

DISMISSING ACTION

Magistrate Judge Rodgers filed a Report and Recommendation on December 24, 2013, recommending that Mr. Booth's civil rights action be dismissed without prejudice for failure to either pay the full filing fee for this action or to complete and file a financial affidavit as required by 28 U.S.C. § 1915(a)(1). There being no objections, the Court ADOPTS the Report and Recommendation, ECF No. 6. The action is DISMISSED WITHOUT PREJUDICE.

IT IS SO ORDERED. The District Court Executive is directed to enter this Order, forward a copy to Plaintiff at his last known address and close the file.
