Feb 26, 1962
15 A.D.2d 812 (N.Y. App. Div. 1962)

Opinion

February 26, 1962

In an action for a judicial separation, plaintiff appeals, as limited by her brief, from so much of an order of the Supreme Court, Kings County, dated July 18, 1961, as denied her motion to set aside a stipulation of settlement heretofore entered upon the record on the prior trial of the action, to declare such trial a nullity, to vacate the defendant's withdrawal of his answer, and to restore the action for trial de novo. Order, insofar as appealed from, affirmed, without costs. No opinion. Beldock, P.J., Ughetta, Kleinfeld, Christ and Hopkins, JJ., concur.
