The petition for writ of habeas corpus is hereby dismissed without prejudice to petitioner's right to refile his arguments in a motion for postconviction relief filed in the sentencing court pursuant to Florida Rule of Criminal Procedure 3.850 following any adverse decision by the First District Court of Appeal in his currently pending direct appeal.
