ANN BIRIS, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Lewis R. Carluzzo Chief Special Trial Judge.

This case for the redetermination of a deficiency, set for trial during the Detroit, Michigan, trial session schedule to begin in that city on September 23, 2024, is before the Court on respondent's motion for continuance, filed May 15, 2024. Giving due regard to the representations contained in the motion, it is

ORDERED that respondent's motion is set for hearing at the place shown in the Notice Setting Case for Trial, served April 25, 2024, at a time and date certain of 2:00 p.m. Tuesday, September 24, 2024. It is further

ORDERED that the parties are excused from appearing on September 23, 2024, as previously directed and need not comply with the obligations imposed upon them in the Standing Pretrial Order served April 25, 2024.

The Court is inclined to grant the motion. The hearing will focus on the future actions the parties intend to take to prepare the case for trial, or to resolve it without the need for one. If the parties agree to a more convenient date and time to conduct the hearing during the trial session, then they should contact the Court to request that the hearing be rescheduled accordingly.
