Bills v. Tabish

Utah Court of Appeals
Apr 19, 2001
2001 UT App. 135 (Utah Ct. App. 2001)

Opinion

Case No. 20010117-CA.

Filed April 19, 2001. (Not For Official Publication)

Appeal from the Second District, Ogden Department, The Honorable Ernest W. Jones.

Alyson Draper Snider, Ogden, for Appellants.

J. Scott Buehler, Ogden, for Appellee.

Before Judges Greenwood, Billings, and Orme.

MEMORANDUM DECISION

For this court to have jurisdiction over an appeal, a notice of appeal must "be filed with the clerk of the trial court within 30 days after the date of entry of the judgment or order appealed from." Utah R. App. P. 4(a). The order that Tabish seeks to appeal was entered on January 5, 2001, and his notice of appeal was due on Monday, February 5, 2001. However, Tabish missed this deadline.

Because we do not have jurisdiction to consider appeals from untimely notices of appeal, Tabish's appeal is dismissed.

Pamela T. Greenwood, Presiding Judge, Judith M. Billings, Judge Gregory K. Orme, Judge.
