Opinion

No. 2D12–4783.

2012-10-29

Laura S. BIALECK, n/k/a Laura S. Taylor, Appellant/Petitioner(s), v. Alan BIALECK, Appellee/Respondent(s).

BY ORDER OF THE COURT.

This appeal is dismissed as untimely. Although the appellant argues that she is seeking to appeal an order denying a motion for relief from judgment under rule 1.540(b), her motion in the trial court and her response to the order to show cause neither recite the grounds for relief under that rule nor demonstrate that such relief was available. Instead, the appellant's “motion for reconsideration and to set aside order on motion to dismiss” was an unauthorized attempt at rehearing of a nonfinal order, and this appeal is untimely.

KELLY, KHOUZAM, and CRENSHAW, JJ., Concur.
