BEVELED EDGE INSURANCE COMPANY, INC., ET AL., Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Lewis R. Carluzzo Chief Special Trial Judge

These consolidated cases for the redetermination of deficiencies are before the Court on: (1) respondent's motion to compel production of documents, filed December 21, 2022; (2) respondent's motion for subpoena hearing, filed December 21, 2022; and (3) a motion by Kenneth Hall to withdraw as petitioners' counsel, filed July 7, 2023. The motions were called from the calendar for hearing in Atlanta, Georgia, on September 12, 2023. Counsel for the parties appeared and were heard.

Premises considered, and for cause set forth more fully in the transcript of the above-referenced proceedings, it is

ORDERED that respondent's motion to compel production of documents is taken under advisement. It is further

ORDERED that the motion by Kenneth Hall to withdraw as petitioners' counsel is granted, and he is withdrawn as petitioners' counsel in each of the cases consolidated in this proceeding.

If only because such motions are routinely granted, it is further ORDERED that respondent's motion for subpoena hearing is granted. It is further

ORDERED that his case is set for a remote hearing on the status of the case during the Washington, D.C., special hearing session scheduled to begin at 1:00 p.m. (Eastern Time) on Wednesday, November 15, 2023, at which hearing any third-party subpoenas issued by any party may be made returnable. It is further

ORDERED that the Clerk of the Court shall serve upon the parties a Notice of Remote Proceeding that contains instructions on how to participate in the above-referenced remote proceeding. It is further

ORDERED that not later than November 12, 2023, any party that causes a subpoena to issued and served under the authority of this Order shall submit a status report that advises the Court whether there has been compliance with the subpoena so as to eliminate the need for the remote hearing.
