On review of Aaron Bethels Petition for Writ of Mandamus, we grant the petition and order the trial court to rule on the petitioners Florida Rule of Criminal Procedure 3.850 Motion for Postconviction Relief filed on August 3, 2009. This motion has been pending since August 3, 2009, and has been continued at least six times. In its' response to the Petition for Writ of Mandamus, the State does not explain why the circuit court has not ruled on this motion.
