Judgment of the Supreme Court, Queens County, entered October 27, 1970, which determined the issues of liability in favor of plaintiff and against appellants, upon a jury verdict, affirmed. No opinion. Appeal from order of the same court, dated October 20, 1970, dismissed. Respondent is allowed one bill of costs. An order denying a motion to set aside a jury verdict in favor of a plaintiff upon a trial limited to the issue of liability is not appealable ( Guarneri v. Aloveiro, 32 A.D.2d 647; Fortgang v. Chase Manhattan Bank, 29 A D 41, 43). In any event, the foregoing disposition of the appeal from the judgment renders the appeal from the order academic. Hopkins, Acting P.J., Munder, Martuscello, Brennan and Benjamin, JJ., concur.
