Bergler v. Koutrakus

Appellate Division of the Supreme Court of New York, Second Department
Nov 1, 1943
266 App. Div. 1004 (N.Y. App. Div. 1943)

Opinion

November 1, 1943.

Order modified on the law and the facts by striking from the second and third ordering paragraphs the words and figures "seven hundred fifty ($750.00)", and inserting in place thereof in each of said paragraphs the words and figures "two hundred fifty ($250.00)". As thus modified, the order, insofar as appealed from, is affirmed, without costs. The election of respondents to accept cash, if they so elect, must be made within five days from the entry of the order hereon; and the time of appellants to make such cash payment is extended until ten days from the entry of the order hereon. In our opinion the allowance made by Special Term is excessive. Close, P.J., Carswell, Johnston, Adel and Taylor, JJ., concur.
