On April 22, 2021, Respondent filed a Motion for Summary Judgment, asking for this Court's ruling as a matter of law that the Internal Revenue Service Whistleblower Office did not abuse its discretion in fully denying Mr. Berenblatt's claim for award. On April 26, 2021, Mr. Berenblatt filed a Motion to Stay Proceedings, asking the Court to defer ruling on Respondent's Motion for Summary Judgment until it had ruled on Mr. Berenblatt's pending Motion to Compel Production of Documents and Motion to Compel Responses to Interrogatories. We granted Mr. Berenblatt's Motion to Stay Proceedings on July 30, 2021.

On May 26, 2023, we issued an Order denying Mr. Berenblatt's Motion to Compel Production of Documents and partially granting his Motion to Compel Responses to Interrogatories. See also Berenblatt v. Commissioner, No. 7208-17W, 160 T.C. No. 14 (May 24, 2023). We now find it appropriate to lift the stay on these proceedings and to require a response from Mr. Berenblatt to Respondent's Motion for Summary Judgment. Accordingly, it is

ORDERED this Court's Order staying the proceedings in this case issued on July 30, 2021, is hereby vacated. It is further

ORDERED that Mr. Berenblatt shall file a response to Respondent's Motion for Summary Judgment, filed on April 22, 2021, by August 25, 2023.
