District Court of Appeal of Florida, First District
Dec 20, 2004
888 So. 2d 670 (Fla. Dist. Ct. App. 2004)

Opinion

No. 1D04-226.

November 15, 2004. Rehearing Denied December 20, 2004.

An appeal from an order from the Judge of Compensation Claims. William D. Douglas, Judge.

William H. McKnight, Tampa, Attorney for Appellant.

Raymond A. Lopez and Austin L. Moore of Rissman, Weisberg, Barrett, Hurt, Donahue McLain, P.A., Orlando, Attorneys for Appellees.

In this appeal of a workers' compensation claim denying Claimant's requested Otto Bock C-Leg to replace a virtually useless older prosthesis, which caused Claimant pain and difficulty ambulating, we hold that the JCC erred in denying the requested Otto Bock C-Leg prosthesis and reverse as to that issue. As to all other issues raised, we affirm.

BOOTH, VAN NORTWICK and PADOVANO, JJ., CONCUR.
