LISA MARIE BELYEW, Plaintiff, v. LARRY LORMAN, et al., Defendants.

ORDER

HON. DANIEL J. CALABRETTA UNITED STATES DISTRICT JUDGE

Plaintiff is a California prisoner proceeding pro se with an action for violation of civil rights under 42 U.S.C. § 1983. A trial confirmation hearing is scheduled for September 7, 2023 and trial is scheduled to begin October 30, 2023. Plaintiff has filed a motion asking that this matter be stayed due to her having difficulties preparing for trial. The Court notes that this case has been pending since 2017, and motion practice in this matter concluded in March 2020. Plaintiff in effect asks for an indefinite stay pending her release from custody, which does not appear imminent.

Therefore, good cause appearing, IT IS HEREBY ORDERED that Plaintiff's motion for a stay (ECF No. 101) is denied. At the trial confirmation, Plaintiff is free to indicate to the Court any material difficulties she is having preparing for trial and the Court will rule as appropriate.

ORDER

IT IS SO ORDERED.
