MICHAEL DAVID BELLOW JR., Appellant v. COURTNEY BELLOW, Appellee

On Appeal from the 356th District Court Hardin County, Texas
Trial Cause No. 54996

ORDER

Michael David Bellow Jr. filed a statement of inability to afford payment of court costs in the appellate court and requested that a reporter's record be prepared. See Tex. R. App. P. 20.1(b)(3), (c)(1). A court reporter opposed the statement of inability and requested that the appellant be required to prove the inability to pay costs. See Tex. R. Civ. P. 145(f)(3). We may refer the matter to the trial court. See Tex. R. App. P. 20.1(b)(3)(B).

It is, therefore, ORDERED that the appeal is abated and the case is remanded to the trial court for a determination of the appellant's indigence for purposes of payment of the reporter's record. See id. The trial court shall hear evidence and issue findings of fact. Id.; see also Tex. R. Civ. P. 145(f)(5), (6). A supplemental clerk's record containing the trial court's findings, together with a reporter's record of the hearing conducted pursuant to this Order shall be filed with the Court of Appeals by March 23, 2017.

ORDER ENTERED February 21, 2017.

PER CURIAM Before McKeithen, C.J., Kreger and Horton, JJ.
