District Court of Appeal of Florida, First District
Jul 15, 1998
712 So. 2d 845 (Fla. Dist. Ct. App. 1998)

Opinion

No. 98-1517

Opinion filed July 15, 1998.

Petition for Writ of Prohibition — Original Jurisdiction.

Scott A. Snavely, Esquire, of Bajoczky Fournier, Tallahassee, for petitioner.

Barbara E. Hill, Tallahassee, for respondent.

Robert A. Butterworth, Attorney General, and Amelia L. Beisner, Assistant Attorney General, Tallahassee, for Judge Smith.

We find that the allegations contained in the instant petition for disqualification, which must be taken as true, are legally sufficient to entitle petitioner to the requested relief. Accordingly, we grant the petition and direct the Chief Judge of the Second Judicial Circuit to appoint a substitute judge to preside over this case.

MINER, ALLEN and KAHN, JJ., CONCUR.
