04 Civ. 8639 (LMM).
January 11, 2005
MEMORANDUM AND ORDER
To resolve the recent litigation over a briefing schedule:
1. The Court understands that the parties' further papers will be served on the schedule set forth in the parties' stipulation so ordered on December 13, 2004, provided, however, that plaintiffs may, at their option, extend their time to serve reply papers from February 2, 2005 to any date not later than February 8, 2005.
2. The NJHA amicus brief is to be served on January 26, 2005. Thus, plaintiffs, if they so choose, may comment on it in their papers to be served on February 2, 2005 (or later). Should defendant find that it needs to comment on the amicus brief, it should apply to the Court for permission to do so.
3. Page limits may be exceeded in all further submissions on the pending motions.
4. February 3, 2005 remains the "return date" of the pending motions. Counsel are not to appear on that date. If oral argument is held, counsel will be notified as to the date and time.
SO ORDERED.
