Case No. 1:04-cv-154-SSB-TSH (S.D. Ohio May. 26, 2006)

Opinion

Case No. 1:04-cv-154-SSB-TSH.

May 26, 2006

ORDER

This matter is before the Court on pro se plaintiff's motion to hold case in abeyance (doc. 42), plaintiff's motion for extension of time to complete discovery (doc. 43), and defendants' motion to extend the discovery and dispositive motion deadlines. (Doc. 44).

Plaintiff and defendants seek an extension of the deadline for filing dispositive motions. (Docs. 43, 44). Plaintiff also seeks an extension of the discovery deadline. (Doc. 43). The Court's most recent calendar order set April 17, 2006 as the deadline for completion of discovery and May 17, 2006 and the deadline for filing dispositive motions. During the pendency of plaintiff's motion to extend the discovery deadline, the parties effectively agreed to conduct discovery beyond the Court's discovery cut-off. The Court will grant plaintiff's motion and extend the discovery deadline to June 17, 2006. The dispositive motion deadline will likewise be extended to July 17, 2006. Plaintiff's motion for stay is therefore moot and will be denied.

IT IS HEREBY ORDERED that plaintiff's motion to stay proceedings (doc. 42) is DENIED AS MOOT; Plaintiff's motion to extend discovery (doc. 43) and defendants' motion to extend the dispositive motion deadline (doc.44) are GRANTED as follow:

Discovery Deadline: June 17, 2006

Dispositive Motion Deadline: July 17, 2006
