DECISION & ORDER ON MOTION
Motion by respondent for leave to re-file a motion for leave to appeal to the Appellate Division from a decision and order of this court dated October 5, 2012, which determined an appeal from an order of the District Court of Nassau County, First District, entered December 7, 2010, and to extend the return date of the motion for leave to appeal to January 11, 2013.
Upon the papers filed in support of the motion and upon the stipulation of the parties, it is
ORDERED that the motion for leave to re-file is granted, the motion for leave to appeal is deemed timely filed, and the return date of the motion for leave to appeal is extended to January 11, 2013.
