Beck v. Wainwright

District Court of Appeal of Florida, First District
Dec 5, 1979
381 So. 2d 1124 (Fla. Dist. Ct. App. 1979)

Opinion

No. SS-171.

December 5, 1979.

Larry H. Beck, pro se.

This is a habeas corpus action alleging a violation of the petitioner's privilege against self-incrimination. However, we are precluded from considering the issue since the petitioner was convicted upon a plea of guilty, and such a plea waives any nonjurisdictional defect occurring prior to the entry of the plea. Ward v. State, 236 So.2d 187 (1st DCA 1970).

Petition denied.

MILLS, C.J., and LARRY G. SMITH and WENTWORTH, JJ., concur.
