MEMORANDUM OPINION AND ORDER
Having considered the most recent correspondence of counsel, the Court makes the following Scheduling Order:
1. In the Court's view, the charges of improper tactical maneuvering counsel exchange tend to cancel each other out. Neither is persuasive. The Court is satisfied that an extension of time to complete the submissions on the pending cross-motions for summary judgment will serve the interests of justice. No further discussion is required, except to say that Mr. Gunsberg's surgical and medical difficulties clearly place the Wasserman Grubin firm under a disadvantage, the severity of which was not and could not have been previously anticipated; and I doubt that Mr. Gunsberg's rehospitalization and apparently uncertain prognosis are motivated by a desire to obtain a tactical advantage in this case.
2. In these circumstances, the time within which Interface must file and serve papers in opposition to Bear Stearns' cross-motion for summary judgment is extended to and including October 9, 2006. The time within which Bear Stearns must file and serve reply papers in support of that motion is extended to and including November 6, 2006. If thereafter the Court desires oral argument on the cross-motions, counsel will be advised by Chambers.
3. Further briefing on Bear Stearns' companion motion to strike Interface's demand for a jury trial is stayed pending the Court's resolution of the summary judgment motions.
