MOTION DECISION

Plaintiffs-respondents having moved for reargument of, or in the alternative, for leave to appeal to the Court of Appeals, from the decision and order of this Court, entered on March 31, 2022 (Appeal No. 14578) (M-2022-01800), And the New York State Trial Lawyers' Association having moved for leave to file an amicus curiae brief in support of plaintiffs-respondents' motion (M-2022-02041), Now, upon reading and filing the papers with respect to the motions, and due deliberation having been had thereon, It is ordered that the New York State Trial Lawyers' Association's motion for leave to file their proposed amicus curiae brief is granted (M-2022-02041), and
It is further ordered that the branch of plaintiffs-respondents' motion which seeks reargument of this Court's March 31, 2022 decision and order is denied, and
It is further ordered that the branch of plaintiffs-respondents' motion which seeks leave to appeal to the Court of Appeals is granted (M-2022-01800), and the following question is certified to the Court of Appeals: Was the decision and order of this Court, dated March 31, 2022, properly made?
Questions of law have arisen which, in our opinion, ought to be reviewed by the Court of Appeals (see CPLR 5713).
