ORDER

On November 24, 2023, the Commissioner (respondent) filed a Motion to Dismiss for Lack of Jurisdiction on the grounds that the Petition was not filed within the time prescribed in the Internal Revenue Code. On December 21, 2023, respondent filed a Response to the Court's Order served November 29, 2023, and a First Supplement to Motion to Dismiss for Lack of Jurisdiction, in which respondent states that he wishes to withdraw his just-described motion.

Upon due consideration of the foregoing, it is

ORDERED that respondent's above-referenced motion, as supplemented, is deemed withdrawn. Petitioner Hari Batnagar is advised that this case remains pending before the Court.
