Opinion
Case No. CV01-0243-S-MHW
September 5, 2002
ORDER
The Court previously reviewed Plaintiffs Complaint, and ordered him to cure deficiencies in the Complaint by filing an amended complaint. Plaintiff next filed a letter, rather than an amended complaint. The information in the letter is virtually the same as in the original Complaint.
The Court previously instructed Plaintiff to allege a causal link between each defendant's actions and the alleged constitutional violation. Contrary to the Court's Order, Plaintiff has failed to state any particular allegations against any particular defendants in his letter.
Finally, a letter is not an amended complaint. Since the year 2000, Plaintiff has had twelve lawsuits pending in this Court, and has been instructed many times on how to file a proper amended complaint. Good cause appearing, the Court shall dismiss Plaintiffs case without prejudice for failure to state a claim upon which relief can be granted.
ORDER
NOW THEREFORE IT IS HEREBY ORDERED that Plaintiffs Complaint is dismissed without prejudice.
