On October 26, 2021, petitioner filed a Motion to Dismiss. On August 12, 2022, intervenor filed a Response to Motion to Dismiss and a Declaration of Chief Foley in Support of Response to Motion to Dismiss. However, further review indicates that the Declaration appears to be more akin to a Supplement to the Response.

Upon due consideration, it is

ORDERED that intervenor's Declaration of Chief Foley in Support of Response to Motion to Dismiss, filed August 12, 2022, is recharacterized as intervenor's Supplement to Response to Motion to Dismiss. 1
