No. 05-09-00399-CV (Tex. App. Aug. 19, 2009)

Opinion

No. 05-09-00399-CV

Opinion Filed August 19, 2009.

On Appeal from the County Court At Law No. 5, Dallas County, Texas, Trial Court Cause No. CC-06-11246-E.

Before Justices MORRIS, RICHTER, and LANG-MIERS.

MEMORANDUM OPINION

In this appeal, the clerk's record was due on May 5, 2009. On July 15, 2009, the Court issued an order directing the Dallas County Clerk to file, within fifteen days, either the clerk's record or written verification that appellant has not paid for the record. The order warned appellant that the Court would dismiss the appeal without further notice if the Court received verification of non-payment. See Tex. R. App. P. 37.3(b). On July 27, 2009, the Dallas County Clerk filed verification showing the record was prepared on June 5, 2009, but appellant has not paid for it.

We DISMISS the appeal for want of prosecution. See Tex. R. App. P. 42.3 (b), (c).
