JUDGMENT

For the reasons stated in the Report and Recommendation of the Magistrate Judge previously filed herein, and after an independent review of the record, and noting the lack of mitten objections filed by Petitioner and determining that the findings are correct under the applicable law;

IT IS ORDERED that the Magistrate Judge's Report and Recommendation [Doc. 13] is ADOPTED; and that Plaintiff's complaint be DISMISSED WITH PREJUDICE as frivolous and for failing to state a claim for which relief may be granted.
