Consistent with the Order Adopting Report and Recommendation entered today, and pursuant to Federal Rule of Civil Procedure 58, it is hereby ORDERED and ADJUDGED as follows:

(1) The Report and Recommendation of the Magistrate Judge (Doc. # 56) is adopted as the Findings of Fact and Conclusions of Law of the Court;

(2) Defendant's Motion for Summary Judgment (Doc. # 46) is granted;

(3) Plaintiff's claims pursuant to 42 U.S.C. § 1983 are dismissed with prejudice, and Judgment is entered in favor of Defendant; and

(4) This matter is hereby stricken from the Court's active docket.
