SIMON BARKAGAN & TATYANA BARKAGAN, Petitioners v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Christian N. Weiler, Judge

On February 20, 2024, respondent filed a status report, which informs the Court that on February 15, 2024, the parties held a conference call to discuss the case. During the call, petitioners' counsel represented that, in order to substitute the amounts paid, petitioners are working on obtaining affidavits from the contractors that worked on the alleged improvements to the property at issue and that obtaining such affidavits will take an undetermined amount of time due to some of the contractors being based in Italy. Respondent requests additional time for petitioners to obtain and review the previously mentioned affidavits.

On February 21, 2024, petitioners filed a status report which informs the Court that during the call on February 15, 2024, petitioners informed respondent that petitioners would try to obtain affidavits from the contractors who worked on the property to substantiate the amounts paid. However, because many of the contractors hired for the improvements were based in Italy, and performed the work nearly two decades ago, petitioners request additional time to locate the contractors and obtain affidavits and will continue to work with respondent to discuss settlement.

Upon due consideration of the foregoing, it is

ORDERED that on or before April 29, 2024, the parties shall file either a proposed stipulated decision document or joint report (or separate reports, if necessary) regarding the status of this case.
