ORDER OF DISMISSAL AND DECISION

This case was called from the calendar at the Trial Session of the Court on October 17, 2016, at Washington, D.C. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and orally moved to dismiss this case for lack of prosecution. The case was recalled later that same day. There again was no appearance by or on behalf of petitioner. Counsel for respondent appeared and was heard. After due consideration, and for cause more fully appearing in the transcripts of the proceedings, it is

ORDERED that respondent's oral Motion to Dismiss for Lack of Prosecution is granted, and this case is dismissed for lack of prosecution. It is further

ORDERED and DECIDED that there is a deficiency in income tax due from petitioner in the amount of $750.00 for the taxable year 2013.
