Before CROW, MONTGOMERY and GARRISON, Judges of the Missouri Court of Appeals, Southern District, transferred to the Missouri Court of Appeals, Eastern District, by Order of the Supreme Court of Missouri.


This court unanimously determines that the judgment for Respondents entered by the Circuit Court of the City of St. Louis in its case number 972-07863, a judge-tried action wherein Appellant sought damages for defamation, shall be affirmed, that no error of law appears, and that an opinion would have no precedential value. This court further determines that those circumstances are dispositive of this appeal. Accordingly, the judgment is affirmed in compliance with Rule 84.16(b)(5), Missouri Rules of Civil Procedure (2000).

The basis for this court's decision is set forth in a written statement attached to this order. The clerk of this court shall furnish a copy of this order and the attached statement to the Circuit Court of the City of St. Louis, to Appellant, and to counsel for Respondents.
