In lieu of granting leave to appeal, the judgment of the Court of Appeals is reversed in part MCR 7.302(F)(1). There is no basis for the Court of Appeals conclusion that it lacked jurisdiction to consider the issues raised on the cross appeal. The case is remanded to the Court of Appeals for consideration of the issues that the Court failed to consider. Jurisdiction is not retained. Court of Appeals No. 174566.
