Balboa v. Julian E. Johnson Sons

District Court of Appeal of Florida, First District
Dec 6, 1979
378 So. 2d 801 (Fla. Dist. Ct. App. 1979)

Opinion

No. OO-223.

December 6, 1979.

Appeal from Circuit Court, Duval County; R. Hudson Oliff, Judge.

Donald E. Grincewicz of the Law Offices of Carroll S. Barco, Orlando, for appellant.

James L. Ade and Stephen H. Durant of Martin, Ade, Birchfield Johnson, Jacksonville, for appellee.

In spite of the argument by appellee that the contract between the general contractor and the subcontractor alters the effect of Snead Construction Corp. v. Langerman, 369 So.2d 591 (Fla. 1st DCA 1978), we find that our decision is governed by Snead.

REVERSED.

McCORD, Acting C.J., and LARRY G. SMITH and SHIVERS, JJ., concur.
