Baker v. United Traction Company

Appellate Division of the Supreme Court of New York, Third Department
Jan 1, 1930
228 App. Div. 744 (N.Y. App. Div. 1930)

Opinion

January, 1930.

Judgments and orders reversed, on the law and facts, and new trial granted, with costs in one action to the appellant to abide the event, on the ground that the verdict is against the weight of the evidence, and because the occurrences on the trial require a new trial in the interests of justice. Appeal from order denying motion for new trial on the ground of newly-discovered evidence dismissed, without costs. Van Kirk, P.J., Hinman, Davis, Hill and Hasbrouck, JJ., concur.
