ORDER


Before the Court is Defendant David Chase ("Chase") and Defendant DC Enterprises, Inc.'s ("DC Enterprises," and together with Chase, the "Defendants") motion for summary judgment under Federal Rule of Civil Procedure 56(c). Plaintiff Robert V. Baer ("Baer" or the "Plaintiff) opposes the Defendants's motion.

Having reviewed and considered the motion papers, opposition thereto, and all reply papers, and for the reasons expressed in the accompanying opinion,

IT IS on this 20th day of February, 2004,

ORDERED that the motion for summary judgment filed by Defendants Chase and DC Enterprises is GRANTED, and it is further

ORDERED that the entirety of the complaint filed by Baer is DISMISSED WITH PREJUDICE.

This case is closed.
