IN THE MATTER OF THE APPLICATION OF MICHELE M. AZZI, PETITIONER-RESPONDENT, v. FOR THE APPOINTMENT OF A GUARDIAN OF THE PROPERTY OF DAVID J. D., AN ALLEGED INCAPACITATED PERSON, PURSUANT TO ARTICLE 81 OF THE MENTAL HYGIENE LAW, JENNY S. TRAPANI, ET AL., APPELLANTS.


PRESENT: , SMITH, CENTRA, PERADOTTO, AND CARNI, JJ.

Respondent having moved to dismiss the appeals taken herein from an order and judgment of the Monroe County Surrogate's Court entered in the Office of the Clerk of said court on December 10, 2014, on the ground that appellants have failed to perfect timely the appeals,

Now, upon reading and filing the affirmation of Brian Laudadio, Esq., dated April 10, 2015, the notice of motion with proof of service thereof, and the affidavit of Michael G. Dwaileebe sworn to April 17, 2015, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and the appeals are dismissed without further order unless the appeals are perfected on or before July 17, 2015.
