Disposition: The Application for Leave to Proceed in the Trial Court filed by William Avery, pro se, is granted insofar as the matter is remanded to the Circuit Court of Lauderdale County "so the trial judge can determine, in his discretion, whether to enhance [Avery's] sentence as a subsequent drug offender, or not."
