ORDER

T. HENLEY GRAVES, Judge.

NOW THIS 18^TH DAY OF JANUARY, 2006, based on the Supreme Court decision dated January 10, 2006, the Superior Court decision dated June 19, 2005, is hereby vacated, and this matter is remanded to the Industrial Accident Board.

FURTHER, the Industrial Accident Board shall vacate its decision dated September 22, 2004, and the Stipulation and Order approved by the Supreme Court shall control the subsequent course of action in this matter.

IT IS SO ORDERED.
