District Court of Appeal of Florida, Fourth District
Feb 4, 1977
351 So. 2d 1045 (Fla. Dist. Ct. App. 1977)

Opinion

No. 76-39.

February 4, 1977.

Appeal from Circuit Court, Brevard County; Tom Waddell, Jr., Judge.

Larry Klein, West Palm Beach, and Poe, Reinman Harrell, P.A., Melbourne, for appellant.

Robert T. Burger, Satellite Beach, for appellee.

Affirmed.

ALDERMAN, J., and GREEN, OLIVER L., Jr., Associate Judge, concur.

DAUKSCH, J., dissents, with opinion.

I recognize the trial court has retained jurisdiction of this matter to reconsider and modify the judgment of permanent alimony but I feel an award of rehabilitative alimony would have been more proper in this case. It would provide some incentive to the wife which might not otherwise result. Therefore I respectfully dissent.
