Opinion

88-1493.

April 6, 1990. Rehearing Denied June 15, 1990.

Appeal from Public Service Commission; Public Service Commission Docket No. 20874.

Don Siegelman, Atty. Gen., and Gregory O. Griffin, Asst. Atty. Gen., for appellant.

Atley A. Kitchings, Jr. and Will M. Booker of Lange, Simpson, Robinson Somerville, Birmingham, for appellee Alabama Public Service Com'n.

Robert C. Black of Hill, Hill, Carter, Franco, Cole Black, Montgomery, and James V. Carideo, Thomas R. Parker, Joe W. Foster and Wayne Goodrum, Tampa, Fla., for appellee GTE South, Inc.

We have considered the appellant's due process claims and find them to be without merit. We therefore affirm the final order of the Public Service Commission approving the settlement between G.T.E. South, Inc., and the remaining intervenors.

AFFIRMED.
