AUTOMOBILES AND MOTOR VEHICLES, § 18.4when judgment finding that indebtedness under conditional sales contract had been cancelled would be affirmed. In action by holder of note and conditional sales contract executed in connection with defendant's purchase of automobile for balance allegedly due, judgment for defendant would be affirmed, where it appeared from evidence that at time car was repossessed by plaintiff's representative, defendant was told by such representative that he would be released from further payments.

Appeal from the Circuit Court of Madison county; the Hon. R.W. GRIFFITH, Judge, presiding.

Judgment affirmed. Heard in this court at the October term, 1946.
