ORIGINAL PROCEEDING (Civ. No. 02-1-0126(3)) (Order)

MOON, C.J., LEVINSON, NAKAYAMA, RAMIL, and ACOBA, JJ.

ORDER

Upon consideration of the petition for a writ of mandamus directed to a judge filed by Petitioners Richard J. Williams and Judith Marianne Williams, the papers in support, and the records and files herein, it appears that: (1) Petitioners are seeking immediate review of a ruling in Apartment Owners of Kaanapali Alii v. Williams, Civil No. 02-1-0126, presently pending in the Circuit Court of the Second Circuit; (2) Petitioners fail to demonstrate that they are entitled to a writ of mandamus. Therefore,

IT IS HEREBY ORDERED that the petition for a writ of mandamus directed to a judge is denied without prejudice to any remedy Petitioners have in the pending circuit court case and without prejudice to any remedy Petitioners have by way of appeal.
