A jury found appellant, Trenton Avery Ashton, guilty of the felony offenses of aggravated sexual assault of a child. In each case, appellant's appointed trial counsel filed a notice of appeal on appellant's behalf and a motion to withdraw, which the trial court granted. The trial court then appointed Susan Criss to represent appellant on appeal.
In each appeal, Matthew J. DeLuca has filed a "Notice of Appearance," requesting that he be designated as new lead counsel for appellant in place of Susan Criss. See TEX. R. APP. P. 6.1(c). The Clerk of this Court is directed to note Matthew J. DeLuca's appearance as lead counsel for appellant on the docket of this Court. However, Susan Criss remains as counsel for appellant until the appeals are exhausted or counsel is permitted to withdraw. See TEX. CODE CRIM. PROC. ANN. art. 26.04(j) (West Supp. 2015); see also TEX. R. APP. P. 6.5 (providing for attorney's withdrawal from representing party in appellate court).
On June 2, 2016, appellant filed a motion for an extension of time to file his brief. The motion is granted. Appellant's brief is due to be filed no later than July 5, 2016.See TEX. R. APP. P. 38.6(a), (d).
