DECISION & ORDER ON MOTION

Appeals from an order of the Supreme Court, Queens County, entered May 15, 2020, an order of the same court dated September 28, 2021, and a judgment of the same court dated October 6, 2021. Motion by the appellants, inter alia, to consolidate the appeals and to stay enforcement of the judgment in the above-entitled action, pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to consolidate the appeals is granted, the record and briefs filed in connection with the appeal from the order entered May 15, 2020 are deemed also to be filed in connection with the appeals from the order dated September 28, 2021, and the judgment dated October 6, 2021, on or before January 13, 2022, the parties shall file, via NYSCEF, digital replacement copies of the record and briefs which contain Appellate Division Docket Nos. 2021-07788 and 2021-07789 in addition to Appellate Division Docket No., and on or before January 13, 2022, the appellants shall serve and file, via NYSCEF, a supplemental brief containing any points of argument in connection with the appeals from the order dated September 28, 2021, and the judgment dated October 6, 2021, and a supplemental record which contains any papers constituting the record on the appeal from the order dated September 28, 2021, and the judgment dated October 6, 2021, that are not contained in the record filed in connection with the appeal from the order entered May 15, 2020; and it is further, ORDERED that the motion is otherwise denied; and it is further, ORDERED that on the Court's own motion, the respondent's time to serve and file a brief in response to the appellants' supplemental brief on the appeals from the order dated September 28, 2021, and the judgment dated October 6, 2021, is extended until February 14, 2022, and the respondent shall serve and file the brief in response via NYSCEF, if applicable or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website.
