Ash v. State

District Court of Appeal of Florida, First District
Jan 18, 1990
555 So. 2d 453 (Fla. Dist. Ct. App. 1990)

Opinion

No. 89-321.

January 18, 1990.

An Appeal from the Circuit Court for Leon County; P. Kevin Davey, Judge.

Michael E. Allen, Public Defender and Kathleen Stover, Asst. Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., and Virlindia A. Sample, Asst. Atty. Gen., Tallahassee, for appellee.

We affirm the departure sentence in this case. However, we reverse the imposition of court costs and remand with directions that the trial court afford appellant notice and opportunity to object to the imposition of the costs. See Shipley v. State, 528 So.2d 902 (Fla. 1988); Jenkins v. State, 444 So.2d 947 (Fla. 1984).

THOMPSON and ZEHMER, JJ., concur.
