Appellant, Arrow Field Services, LLC, filed an "Unopposed Motion to Provide Original Excel File Exhibits Pursuant to [Texas Rule of Appellate Procedure] 34.6(g)(2)." In its motion, appellant notes that there are "several exhibits that were offered and admitted into evidence at trial as native [E]xcel files" which have not been filed as a part of the appellate record in this appeal. Appellant states that a USB drive was provided to the court reporter including several native Excel files, including "PX-651," "PX-736," "PX-740," and "DX-721."
Appellant's motion therefore requests that this Court direct the trial court clerk "to forward this [USB] drive to th[is] Court," as they are "relevant to [appellant's arguments on appeal." Appellant's motion includes a certificate of conference stating that appellee is not opposed to the relief requested in the motion. See Tex. R. App. P. 10.1(a)(5), 10.3(a)(2).
Appellant's motion is granted. The trial court clerk is directed to send the USB drive containing the exhibits identified in this order to the Clerk of this Court within fourteen days of the date of this order. See Tex. R. App. P. 34.6(g)(2) ("On any party's motion or its own initiative, the appellate court may direct the trial court clerk to send it any original exhibit.").
It is so ORDERED.
