District Court of Appeal of Florida, Fourth District
Dec 10, 1986
498 So. 2d 642 (Fla. Dist. Ct. App. 1986)

Opinion

No. 4-86-1232.

December 10, 1986.

Appeal from a non-final order of the Circuit Court for Broward County; Joseph E. Price, Jr., Judge.

James L. Armstrong, III and Anthony Deglomine, III of Smathers Thompson, Miami, for appellant.

William S. Cassel, Fort Lauderdale, for appellees-Shoher and Sun Bank/South Florida, N.A.

Appellant raises two issues. We affirm as to the first because there is substantial, competent evidence to sustain the action of the trial court. We affirm as to the second because appellant did not raise the issue in the trial court.

LETTS, GLICKSTEIN and WALDEN, JJ., concur.
