Respondents to the petition for permissive appeal filed in Appellate Cause No. 01-15-000989-CV have requested clarification regarding whether the issue set for submission on February 23, 2016 will be limited to the propriety of a permissive appeal or whether the merits of the appeal will be considered.
The request for clarification is GRANTED. Because the petition for permissive appeal and the petition for a writ of mandamus filed in Appellate Cause No. 01-15-00990-CV are related, the court will consider the issues presented in both at the oral argument, including the underlying merits to the extent that the petition for writ of mandamus raises them. The parties should be prepared to address any questions from the court regarding any the issues set forth in the parties' briefing. See TEX. R. APP.
