Galen v. Cnty. of Los Angeles, 477 F.3d 652, 666 (9th Cir. 2007). The Court looks to whether the complaint was frivolous “at the time the complaint was filed.” Arnaudo v. Cnty. of Yavapai, No. CV-16-08164-PCT-DJH, 2019 WL 652865, at *3 (D. Ariz. Feb. 15, 2019) (quoting Tutor-Saliba Corp. v. City of Hailey, 452 F.3d 1055, 1060 (9th Cir. 2006)). An action is not frivolous simply because the plaintiff did not prevail.
